This week, Senator Mike Enzi (R-WY) filed the Marketplace Fairness Act as an amendment to the Highway Trust Fund bill currently pending in the U.S. Senate. Senator Enzi’s aides confirmed that the amendment is the same Internet sales tax language that was passed last May in the Senate.
Congress must soon pass a Highway Trust Fund bill to ensure that infrastructure projects would be funded through the rest of the year. The Senate is poised to take a bill to the floor in the near future and Senators have been asked to file amendments to the legislation. Senator Enzi’s amendment is one of many amendments being filed on the bill.
eBay Inc. opposes any attempts to pass an Internet sales tax bill that does not adequately protect small tech-enabled small businesses. The Senate passed Marketplace Fairness Act only includes a $1 million small seller exception and would allow state tax enforcement agencies to force their laws on businesses located in different states.
